Invite Terms

These terms apply to all invitations and other communications you send through Qflow, alongside our Terms & Conditions.

Undelivered emails

You will see a list of delivery issues on your delivery status page if any occur. This will outline the issue we experienced whilst trying to deliver the invite to your guest.

Qflow is not liable for undelivered invites, which can be caused for a number of reasons.

If a message is Deferred or Queued the message will be retried for up to 72 hours. This could be because the guest’s inbox is full or currently unavailable.

If a message has Bounced this means it has been rejected by the mail server.

If a message has been Marked as Spam the recipient has rejected it.

If a message has been Dropped this means the email address is incorrect or the inbox no longer exists.

If a message has been Unsubscribed this means the recipient has clicked the unsubscribe button in the email.

General rules

You promise to follow these rules:

  1. You won’t send spam! By "spam" we mean the definition on the Spamhaus website.
  2. You won’t use purchased, rented, or third-party lists of email addresses.
  3. You will only send to guests who have consented to hear from you, or where you otherwise have a lawful basis to contact them.

If you violate any of these rules, then we may suspend or terminate your account.

Reporting abuse

If you think anyone is violating any of these terms, please notify us immediately at support@qflow.email. If you received spam you think came from a Qflow user, please forward the message to us and we will investigate.

Bandwidth abuse / throttling

You may only use our bandwidth for your Qflow emails. We provide image and data hosting only for your invitations and other Qflow communications, so you may not host images on our servers for anything else (like a website).

Compliance with laws

You represent and warrant that your use of Qflow will comply with all laws and regulations that apply to you and to the recipients you contact — including data protection, electronic marketing and anti-spam laws such as the UK GDPR, the EU GDPR and the Privacy and Electronic Communications Regulations (PECR), and their equivalents in the countries you send to. You are responsible for determining whether Qflow is suitable for you in light of any sector regulations you are subject to; if it does not meet those requirements, we will not be liable.

In building your guest lists, sending communications via Qflow, and collecting information as a result, you warrant that you:

  1. will clearly describe in writing how you plan to use any data collected, including for your use of Qflow, and will comply with whatever privacy notice you have posted;
  2. have complied, and will comply, with all data protection, electronic communication, and privacy laws that apply where you are sending;
  3. have collected, stored, used, and transferred all data relating to any individual in compliance with those laws, and have the necessary permission to allow Qflow to receive and process that data and send communications to that individual on your behalf; and
  4. agree to indemnify and hold us harmless from any losses, including legal fees, that result from your breach of any part of these warranties.

Limitation of liability

To the maximum extent permitted by law, you assume full responsibility for any loss that results from your use of the sending features of the Service. We won’t be liable for any indirect, punitive, special, or consequential damages under any circumstances, even if they’re based on negligence or we’ve been advised of the possibility of those damages. Our total liability for all claims relating to communications sent in any month will be no more than what you paid us for the Service the month before.

Fair usage

You agree to a fair use of the service. We provide custom plans for heavy or extremely high usage. We may contact you about your sending if we see sustained high bounce rates, spam complaints, or unusually high volume — usually to help you fix list quality, or to move you to a plan that fits your usage.

No warranties

To the maximum extent permitted by law, we provide the sending features of the Service as is. That means we don’t provide warranties of any kind, either express or implied, including but not limited to warranties of merchantability and fitness for a particular purpose. Since people use Qflow for a variety of reasons, we can’t guarantee that it will meet your specific needs.

Indemnity

You agree to indemnify and hold us harmless from any losses, including legal fees, that result from claims you make that aren’t allowed under these terms due to a "Limitation of Liability" or other provision, and from third-party claims that you or someone using your password did something that, if true, would violate any of these terms.

Enforcement

If we file an action against you claiming you breached these terms and we prevail, we’re entitled to recover reasonable legal fees and any damages or other relief we may be awarded. If you violate these terms we may also seek injunctive or other equitable relief.

Force majeure

We won’t be held liable for any delays or failure in performance of any part of the Service from any cause beyond our control, including acts of God, changes to law or regulations, embargoes, war, terrorist acts, riots, fires, earthquakes, floods, strikes, power blackouts, unusually severe weather conditions, and acts of hackers or third-party internet service providers.

Amendments and waiver

Amendments or changes to these terms won’t be effective until we post revised terms on the website. If we don’t immediately take action on a violation of these terms, we’re not giving up any rights under the terms, and we may still take action at some point.

Notification of security breach

In the event of a security breach that may affect you or anyone on your guest lists, we’ll notify you of the breach and provide a description of what happened. If we determine, and notify you, that you need to forward all or part of that information to anyone on your guest lists, you’ll promptly do so.

Notices

Any notice to you will be effective when we send it to the last email or physical address you gave us. Any notice to us will be effective when delivered to: Wiretouch Limited, 2A Church Road, Hove, East Sussex, BN3 2FL, or any address we may later post on the website.

Changes to these terms

Qflow for events™ reserves the right to change these terms at any time. In the event that any changes are made, the revised terms shall be posted on this page with an updated date. Please check the latest information posted herein to inform yourself of any changes.
